Taxation Essentials 2020 – Series 4 – 8 Hours Tax CPD For Irish Accountants

This 8 Hour Tax event covers a range of topical tax issues that have been specifically identified as either persistent problem areas or opportunities for accountants to be proactive in the identification and implementation of taxation solutions for their clients.

Session 1: Employed v Self-Employed – 2020 Update

Every practitioner will be aware of how often the payroll tax obligations of their clients are considered in Revenue Audits, from the treatment of an office cleaner to the status of a doctor’s locum. The tax and social insurance legislation contain no definitions of an “employee” so it can be difficult to advise clients on this complex but always important area. This session will focus on explaining the relevant guidance from the Revenue Commissioners and Department of Employment Affairs & Social Protection, how recent Irish court judgements and tax appeals have clarified what can be considered an “employee” for tax purposes, and the ongoing issue of how to classify company directors for PRSI purposes

Areas to be covered will include:

  • The “tests” used by Revenue and DEASP in deciding employment status
  • A review of the Code of Practice for determining employment status
  • The importance of Irish court judgements and tax appeals in recent years and how you can use them to advise your clients
  • A review of a recent High Court tax case on employment status in the “gig” economy
  • PRSI classification of company directors

Session 2: Capital Gains Tax Relief Overview

Increasing numbers of clients are looking to plan for retirement and the sale or transfer of their business. This session aims to provide an analysis of the different types of reliefs that are available and how a client can be advised in readying the business for its sale/transfer.

Bullet points –

  • Review of the main reliefs including retirement and entrepreneur
  • Sale to a third party and the pre-planning required such as the split of property and trade
  • Transfer to family – possible extraction of cash via share buyback
  • Transfer to family – overview of business relief available for the next generation

Session 3: Tax Appeals Update

The fundamental changes to the Irish tax appeals system four years ago mean that tax appeals should now be more accessible and transparent than ever before. The Tax Appeals Commission has recently been given greater resources which has led to an increase in the flow of appeals heard and settled. As the relationship between taxpayers and Revenue becomes more confrontational , all practitioners should familiarise themselves with the modern appeals system.

Areas to be covered in this session will include:

  • A practical step-by-step guide to the new tax appeals system
  • An analysis of recent changes made to the tax appeals process with practical examples
  • A consideration of some recent relevant Tax Appeals Commission determinations and High Court judgements

Session 4: Preparing Income Tax Returns – 2019

In advance of the busy tax filing season this seminar will bring the practitioner through the increasingly complex Form 11 as well as providing topical tax tips and identifying pitfalls to be aware of when preparing the returns and computations. The object of this session is for practitioners to be ready for tax filing well in advance of the return deadlines and to be in a position to complete returns as efficiently as possible.

Bullet points –

  • Refresher on completing the income elements of the Form 11 including Case I/II and Case V (and allowable Case V costs)
  • The interaction between the return and real-time payroll
  • Review of available credits and reliefs that can be claimed including calculating allowable pension contributions
  • Understanding how Revenue use the information provided to them in the tax return
